Financial Responsibility and Promise to Pay

Students must read and acknowledge the Financial Responsibility and Promise to Pay Agreement through their LeopardWeb account during each semester’s registration.

Throughout this document, “I” refers to and represents the Wentworth Institute of Technology student.

I fully understand and agree that my authorization to enroll and continue to register for courses at Wentworth Institute of Technology (Wentworth) is expressly conditioned on my acceptance of the terms and conditions of this agreement (“Agreement”) set forth below. In exchange for the opportunity to enroll at Wentworth, to receive educational services, and for other valuable considerations I agree to the following terms and conditions:

Payment of Fees / Promise to Pay

I understand and agree that by registering for any class or receiving any service from Wentworth, I accept full responsibility to pay all tuition, fees and other associated costs assessed because of my registration and/or receipt of services. I understand and agree that my registration and acceptance of these terms constitutes a promissory note agreement (a financial obligation in the form of an educational loan, as defined by the U.S. Bankruptcy Code at 11 U.S.C. §523(a)(8)) in which Wentworth is providing me educational services and deferring some or all my payment obligation for those services, and I promise to pay for all assessed tuition, fees, and other associated costs by the published or assigned due date.

I understand and agree that if I drop or withdraw from some or all the classes for which I register, I will be responsible for paying all or a portion of tuition and fees in accordance with the published Tuition Proration Policy in the Academic Catalog and/or any other policy specific to my program or department, which I am responsible for reviewing and understanding. I have read the terms and conditions of the published Refund Policy for Student Accounts and understand those terms are incorporated into this agreement by this reference. I further understand that my failure to attend class or receive a bill does not release me from my financial responsibility as described above.

Consistent with Wentworth’s Delivery of Services policy, more completely described in the Academic Catalog, in the event that Wentworth determines it must suspend or alter its operations in whole or in part due to epidemic, pandemic, other public health emergency, extreme weather, natural disaster, acts or threatened acts of terrorism or war, or any single act or combination of events beyond the University’s control, Wentworth may suspend, reduce, terminate and/or modify its operations in whole or in part, which may or may not include offering online or other alternative learning options, at its discretion. In any such event, Wentworth is under no obligation to refund or credit any portion of tuition, fees, or other charges paid or owed, but it may do so at its discretion.

I have read, accept, and understand Wentworth's student account related policies on the Student Accounts Office web site, which includes information about the following:

Method of Billing

I understand that Wentworth uses electronic billing through the LeopardWeb portal as its official billing method, and therefore I am responsible for viewing and paying my student account E-Bill by the scheduled due date. I further understand that failure to review my billing statement does not constitute a valid reason for not paying my bill on time.

Billing Errors

I understand that administrative, clerical, or technical billing errors do not absolve me of my financial responsibility to pay the correct amount of tuition, fees and other associated financial obligations assessed as a result of my registration at Wentworth and to make payment, enroll in a payment plan and/or have pending financial aid, or certified loan funds in place by each semester’s due dates.

Returned Payments / Failed Payment Agreements

If a payment made to my student account is returned by the bank for any reason, I agree to repay the original amount of the payment plus a returned payment fee. Tuition and fee information can be found on the Tuition and Costs web page. I understand that multiple returned payments and/or failure to comply with the terms of any payment plan or agreement I sign with Wentworth may result in cancellation of my classes and/or suspension of my eligibility to register for future classes at Wentworth.

Withdrawal

If I decide to completely withdraw from courses, and/or from Wentworth, I will review the timing and financial implications of withdrawal as stated in the Tuition Proration Policy in the Academic Catalog I further understand that, if withdrawing, I must also check policies established by my school or college/major, the Financial Aid Office, Division of Technology Services and Residential Life.

Past Due Account / Collection

I understand and agree that if I fail to pay my student account bill or any monies due and owing Wentworth by the scheduled due date, Wentworth can place a hold and/or assess late payment fees to my student account. Please see the Student Accounts Office website for more information.

I understand that, if I fail to pay my student account bill or other monies owing to Wentworth by the scheduled due date and fail to make acceptable payment arrangements to bring my account current, Wentworth may refer my delinquent account to a third party, which may be a debt collection company or an attorney. I further understand that if Wentworth refers my student account balance to a third party for collection, a collection fee will be assessed and will be due in full at the time of the referral to the third party. The collection fee will be calculated based on the amount of the outstanding account balance, up to the maximum amount permitted by applicable law. If a lawsuit is filed to recover an outstanding balance, I understand that I will also be responsible for any costs associated with the lawsuit such as court costs. I also understand that my delinquent account may be reported to one or more of the national credit bureaus.

Financial Aid

I understand that aid described as “estimated” on my Financial Aid Award does not represent actual or guaranteed payment but is an estimate of the aid I may receive if I meet all requirements stipulated by that aid program.

I understand that my Financial Aid Award is contingent upon my continued enrollment and attendance in each class upon which my financial aid eligibility was calculated. If I drop any class before completion, I understand and agree that my financial aid eligibility may decrease and some or all financial aid awarded to me may be revoked. If some or all my financial aid is revoked because I dropped or failed to attend class, I agree to repay all revoked aid that was disbursed to my account and resulted in a credit balance that was refunded to me.

I agree to allow financial aid I receive to pay all charges assessed to my student account such as tuition, fees, campus housing and dining, student health insurance, service fees, fines, bookstore charges, or any other amount, in accordance with the terms of the aid

Communication

I understand and agree that Wentworth uses students’ Wentworth email addresses as the official method of communication, and that I am responsible for reading the emails and messages that I receive from Wentworth at that email address on a timely basis.

I authorize Wentworth and its agents and contractors to contact me at my current and any future mailing addresses, cellular phone number(s), email address(es), or wireless device(s) regarding my delinquent student account(s)/loan(s), any other debt owe to Wentworth, or receive general information from Wentworth. I authorize Wentworth and its agents and contractors to use automated telephone dialing equipment, artificial or pre-recorded voice or text messages, and personal calls and emails, in their efforts to contact me. However, I understand that I may withdraw my consent to call my cellular telephone by contacting the Student Accounts Office. I understand and agree that I am responsible for keeping Wentworth records up to date with my current physical addresses, email addresses, and phone numbers. Changes to this information can be made in the LeopardWeb portal.

Upon leaving Wentworth for any reason, I understand that it is my responsibility to provide Wentworth with updated contact information for the purposes of continued communication regarding any amounts that remain due and owing to Wentworth.

IRS Form 1098-T

I agree to provide my Social Security number (SSN) or taxpayer identification number (TIN) to Wentworth upon request as required by Internal Revenue Service (IRS) regulations for Form 1098-T reporting purposes. If I fail to provide my SSN or TIN to Wentworth, I agree to pay all IRS fines assessed because of my missing SSN/TIN.

I consent to receive my annual IRS  1098-T form electronically from Wentworth. I understand that if I do not consent to receiving my 1098-T form electronically, a paper copy will be provided. I understand that I can withdraw this consent or request a paper copy by following the instructions found in the 1098-T section of the Student Accounts Office website.

Miscellaneous

I understand and agree that if I am younger than the applicable age of majority (generally, 18) when I execute this agreement, that the educational services provided by Wentworth are a necessity or essential service, and I am therefore contractually obligated by this agreement.

This agreement supersedes any previous understandings, representations or correspondence between me and Wentworth regarding the specific terms and conditions contained in this agreement and cannot be modified or affected by any course of dealing or course of performance. This agreement may be modified by Wentworth if the modification is signed by me (electronically or otherwise).

If any provision of this agreement, or any amount charged under this agreement, is determined to be illegal or unenforceable, the remaining provisions of the agreement will remain valid and enforceable to the extent permitted by law. This agreement and the performance of this agreement are governed by the laws of the Commonwealth of Massachusetts, without giving effect to its principles of conflict of laws, and I agree that the state and federal courts located in eastern Massachusetts will have authority to resolve any dispute arising out of this agreement.

This agreement will remain in full force and effect for as long as I am enrolled in any class or program at Wentworth, and thereafter for as long as I owe any amount of money to Wentworth.

I understand that Wentworth is bound by the Family Educational Rights and Privacy Act (FERPA) from the U.S. Department of Education.

By typing your signature, I understand and agree that I am signing this agreement electronically and my electronic signature is the legal equivalent of my manual signature on this agreement under Massachusetts state law. I understand and agree that the electronic signature appearing on this agreement is the same as my handwritten signature for purposes of validity, enforceability, and admissibility.
